2. Data Use & Legal Basis

We process data based on:

• Contractual Necessity: To fulfill your travel bookings and issue permits/tickets.
• Legal Obligation: To comply with tourism regulations and fraud prevention.
• Legitimate Interests: To improve our services and ensure marketplace safety.

3. Data Sharing

We do not sell your data. However, as a travel agency, we must share necessary details with third parties (Airlines, Hotels, Trekking Guides, and Insurance Providers) to fulfill your booking.

4. Security

TERMS AND CONDITIONS

1. Definitions

• FLYKTM.COM: The online platform and intermediary.
• Sellers/Vendors: Local tour operators, hotels, and trekking guides.
• Buyers/Users: Travelers booking services.

2. Using the Website

Users must not post false information, circumvent platform fees by booking with vendors directly, or infringe upon the safety of other travelers.

3. Cancellations & Refunds

Given the logistical complexity of Nepal travel, the following applies:

• Booking Deposit: A non-refundable 5% booking fee plus £100 is required for advanced reservations.
• Full Payment: Must be settled 3 days prior to the departure/event date.
• Traveler Cancellation:
  • 48-hour Window: Full refund (less booking fee) if cancelled within 48 hours of booking.
  • After 48 hours: A 20% cancellation fee of the total order applies.
  • Late Cancellation: Cancellations within 7 days of the trip date are subject to vendor-specific penalties (often 50-100%).
• Vendor Cancellation: If a vendor cancels after accepting an order, the traveler receives a 100% refund. The vendor is responsible for finding a suitable alternative if the trip starts within 24 hours.

4. Force Majeure & Nepal-Specific Risks

FLYKTM.COM is not liable for cancellations or delays caused by:

• Natural Disasters: Landslides, avalanches, earthquakes, or floods.
• Weather: Flight cancellations to high-altitude airports like Lukla (Everest) or Jomsom.
• Acts of Government: Lockdowns, strikes (bandhs), or changes in permit regulations.

Note: We are under no obligation to provide a refund in these circumstances. We will instead facilitate alternative arrangements or rescheduling between the Buyer and Seller.

5. Disputes & Liability

Disputes regarding the quality of trekking or safari services must first be addressed directly with the provider. If unresolved, FLYKTM.COM acts as a mediator with absolute discretion to make a final determination. Our liability is limited to the maximum extent permitted by law.
